Intentions :

3. Résumé


Concerning the province of Québec, the authors mentioned that «persons living in a de facto union in Quebec are not entitled to the family residence protection the Civil Code of Québec provides for individuals who are married or in a civil union.» (p. 92) They also claim that «[w]hen a relationship between unmarried cohabitants in Quebec breaks down, there are no spousal support obligations or entitlements as there are in the previous three jurisdictions discussed.» (p. 92) Also, concerning the rights on a partner’s intestate death, the authors mention that «[u]nmarried cohabitants are not legal heirs of each other under Québec’s Civil Code. If a person living in a de facto union dies without a will, the estate is divided among the legal heirs of the deceased according to the succession rules of the Civil Code of Québec— rules that progress through family members but notably exclude unmarried cohabitants (de facto spouses).» (p. 93)
