«Whether it is in the context of advising a client on estate and life planning, through the preparation of a will, a mandate given in anticipation of one’s incapacity (‘mandate’), a power of attorney or advance directive or around the time of the coming into effect of these instruments or in the manner of their performance, we often have to deal with the family members in an array of situations raising important ethical considerations for the practitioner and providing important opportunities to clarify and define wishes, to prevent mistakes from happening and to resolve problems before they lead to litigation. The emotional and legal costs of litigations are high. No fiercer fights are fought than by family who feel wronged by a parent or family member whether justified or not: children against a parent, conflicts between siblings and older parents exploited and manipulated, families torn asunder and millions of dollars wasted.» (p. 101)
